Unhappy Isn't this Big Time Retaliation???

* I received a phone call on July 11th from the ***. Dean and was verbally abused with unprofessional, demeaning, disrespectful and inappropriate behavior because I responded to a 1st aid incident (which I am trained and certified for with the Red Cross and employer paid for)
* I have been on a Medical Administrative Leave (emotional collapse) since 7/12/06 and am being pressured to return back to work because I've been told numerous times by 3 different individuals within these past weeks that my banked hours of sick/vacation days are running out for me and I really need to return back to work.
* I notified them of Harassment on July 26 and that noticed was ignored.
* I was also told they can not guarantee this will not happen again and was referred to harassment definition on 8/22/06. Appendix 14 Harassment Complaint Procedures. Good Luck to you finding that on-line.
* As of 08/30/06 I have been told I can no longer go into my place of employment or to have any contact with anyone at the place of my employment, except for, Vice President of Human Resources (he's only been there 4 months).
* As of 08/31/06 I have been denied email access through my work account, without reason or notice.
Is this retaliation???

Default when on a medical leave

You’re on medical leave. The law likely provides that you be paid for a set period of medical leave, from your sick days, and then it stops. If they agreed, you could remain on unpaid leave. It is not unreasonable that they ask you to contact Human Resources before you return to work. And if they believe you have emotional problems (which you tell us you do have), they can ask you to not contact others at work, until you are given a medical release by your doctor to return to work. It’s that simple.
The harassment is a separate issue. Bosses and employers can be rude, they can be jerks, they can be demeaning, there is nothing illegal about that to my knowledge. They may have considered your notice of harassment, they may have investigated it, and they may be waiting until you get and give them a medical release from your doctor to return to work. When you do, they could ask you to be evaluated by THEIR physiologist, if they so choose.
While you are not on active work duty, your email account can be disabled, that is their right to do so.
