I would like some advice on what to do regarding wrongful termination. I was fired from my job as well as arrested while at work. Reason for being fired was that I was giving customers overrides on some of their merchandise.

I'm more curious about the outcome of the arrest. An arrest doesn't necessarily lead to conviction in most jurisdictions. Were the charges dropped? Were you convicted? Depending on those circumstances (and that outcome,) you may have different recourse. If it can be proven that the charges were dropped & then determined to be completely untrue (false,) I think you may have other legal options available. Again, that can better be determined by an attorney, but personally, I think worth investigating. *You didn't indicate either way, but this is obviously assuming you've done nothing wrong. I worked for a co. for 29 years. I have worked under 2 different managements. I worked & trained a male coworker for 4 years. I was the office manager. This coworker from the start did not like taking directions from me. The last 4 months I & this coworker had many verbal conflicts. The owner was aware of these. She constantly made excuses for him. A verbal confrontation took place between myself & this coworker. Owner was aware. She gave me the next day off-she called it her holiday for me. When I did go back she terminated me for "terristic threat" towards another employee. I have never been written up before. There is no company handbook. The owner after being fired,fromthe get go she did not like me. She promoted the coworker to my position. She is also telling all the customers I retired. Is there anything I can do?I have never had a problem with any other male. I worked in a construction company and dealt with probably a million males and never once had any complaints on me. When I was fired the owner said she would give me a good reference. Now to me that is a very contradictory statement. This coworker has had problems in the past with other coworkers and customers, the owner was very aware of these. To me she just did not want me there. I intimidated her apparently. Does that give her the right to fire me? Again in the 29 years I worked for this company I only received thanks from all the customers. I sure can use some advice.

It depends. If you are not in a right to work state, she can terminate you at any time without cause ( aside from the obvious---religion, gender, etc).
Also, her telling people you retired seems like a better explanation--at least a socially correct one. Would you rather her go into detail about HER reasons she fired you (even if they aren't fair)? In what state do you reside? |
