Hi - I have a question that I hope someone can answer. A few months ago I posted a thread concerning a co-worker harrassing me and everyone else on the job. I did report it to my boss and she talked to the girl, several times, with no result. About 7 weeks ago, my boss told me they were beginning my termination process due to violation of the attendance policy (3 days within 3 months). She let me work the rest of that shift, but took me off the schedule for the next few days. She told me I should file a grievance with HR as she knew there were extenuating circumstances involving my absences. I did file it and also talked to someone in HR, and this woman told me that they had 10 days to either continue with the termination or overturn it. However, that was 7 weeks ago and I have not heard anything. I have talked to my boss several times but she is frustrated as she has called HR repeated times with no return call. She said I should definitely fight this as she felt that I was doing very well and she didn't want to lose me. I also told the woman in HR about this co-worker and the harrassment, but nothing was done. What doesn't make sense is they have never asked me to return my ID badge, which gives me access to everywhere in the hospital, and my health insurance is still in effect. If they only had 10 days to let me know one way or the other, and it has now been almost 7 weeks, is there anything I can do about this? Also, if am still technically employed, why couldn't I have continued working while they were making this decision? I have been looking extensively for other employment figuring this wouldn't work out anyway, but have had no luck whatsoever. If anyone can help it would be very much appreciated, thank you

Thank you for the advice, I will try contacting an attorney. Yesterday I just received a certified letter from my employer stating that they've "forgiven" several of the absences, but going by the letter, it doesn't state if they have made a final decision or not. Then today I received a letter from the benefits company, saying that since I did not enroll during the open enrollment period (during the time I was off the schedule and figured I was fired), they just picked the basic benefit package for me. I did call and talk to someone at the benefit dept., and she even called HR at the hospital to find out if I was still an employee or not but she got nowhere. Now if I am still employed, I'm stuck with the benefits for next year that they picked. When I told the woman at the benefits company what was going on, she was shocked and couldn't believe they have let this go on so long. I guess as far as an attorney, this would fall under employment law? Thanks again for your help
