Employer, Wrote up rules.

Hello,

I have a family member that lives and works in MI (Michigan).

She works at a privately owned gas station. (Not a big name)

List of Rules:
  1. Fill your cooler
  2. Sweep and mop floor
  3. Make sure at the end of your shift every thing is locked up
  4. Don't wine
  5. No selling drugs here
  6. This is not a hang out
  7. Don't ask for a loan
  8. Do your job
  9. No talking back to the boss
  10. No changing shifts without asking me first
  11. Every thing you get here must have a receipt taped to it from know on if I come in and see something without a receipt you will be terminated no exceptions!
  12. Make sure the alarm is set no more than 25 after 11:00 pm
  13. Ice box and outside cooler must be locked
  14. This is not a hang out so if you have someone here it will be for no longer than 5 minutes
  15. Make sure you drawer is 125.00 for the next shift
  16. No more than 300.00 on hand at any one time for robbery purposes
  17. If there is a robbery you will pay back what was lost, if it doesn't get returned
  18. From know on if you are short in the drawer than your pay is short
  19. Make sure the trash cans outside are empty
  20. if you are not working inside then grab a broom and sweep the parking lot.
  21. bring in stuff from sheds if needed in store

Few things bother me and wondering if it is legal.

He has an insurance company and puts a claim in and gets his money back and still makes the employee pay it back if it doesn't get returned. - Wouldn't that be insurance fraud? Even if not, The employee shouldn't be responsible is it legal for him to do that?

Basically this means when paper work has been completed and it comes up short, It will come out of the employees pay. That legal? As he could write it off as LOSS at the end of the year.

At the end, Shows the Employers - First and Last Name (Printed from PC)
Then:

Owner: First Name

No last name and/or dated.

The employees didn't sign this it's a notice to all employees, therefore I don't think it could be legal binding by his name is incorrectly signed and the employees never did so.

Please correct me if I'm wrong. (The typo's from the list are from the employer not me)

His SAYING the employee is responsible for a robbery does not mean he can actually MAKE that to be the case under the law.

There is no law against his SAYING that is his intention.

Also, if an employees drawer is short it is customary for the employee in question to pay the amount or it is assumed it was stolen.

If the drawer is off, it is the clerks error, period. Why shouldn't they be responsible for their error?

Also, gas stations, often referred to as "stop and robs", often times "robbery" can be staged and/or allowed/ facilitated by the clerk on duty and they share the stolen proceeds.

His goal is to discourage employees from facilitating and participating in stealing, ostensibly to reduce loss.

Actually this is his attention as it's on states on "Rules" paper. Fact is, He has an insurance company, If robbed he puts a claim in...The employee still has to pay. There he's doubleing his money and is considered fraud.

Not always clerks error, This is what happens;

Clerks come up fine, but when the employer checks it out he takes all the money from each shift and puts it together and calculates and some how comes up short and clerk is at fault because based of his typeing skills I assume his math skills isn't great either.

Recently the Gas Station got a lottery machine which is what is coming up short. Gas and snaks...come up fine. Family member that works there tells them sorry it down. When it's not as doesn't want to be responsible.

I don't know what town you live in, but our town usually never had any robberys and I gurantee you none of them is staged and if there are staged robberies not happening there, point is robberies isn't going to stop because workers know the rules and not going to discourage them in anyway.

Too be honest, Grace are you even a lawyer? or just giving some basic advice?
