the owner of the company is a tough cookie at the best of times and has now threatened that he will find 'other ways' to get the money back. i know he LOVES his lawyers and wouldnt think twice about getting them involved if he thought it would help.
i guess what i am asking is - can he indeed take some kind of 'legal' action...?
can anybody shed some light?

Bottom line: if you owe money and you do not pay it in keeping with the terms of the agreement, then he can sue you.
Will he? No one here knows that.
