Unhappy Oregon Family Medical Leave Question

My son was injured and hospitalized with a serious life threatening condition. Sudden accute compartment syndrome which required emergency surgery to save his limb and life. I immediately contacted my employer and verbally requested to be placed on leave until further notice.

My son was in the hospital for 9 days and underwent 4 surgical procedures. I called about every 2 days to update my job. I called them again to let them know that I expected to return to work about 4 days prior to my return.

While I was out my HR department sent me the appropriate medical leave forms to be filled out by my son's doctor. I had the papers faxed back to them within 2 days of reciept.

I just got back to work today and was written up because I didn't call every single day while I was on leave. I was never told that this was a requirement and it states in our employee handbook that periodic updates are required. there was only 2 days that I didn't call with an update.

I was told that it's because my leave hadn't been approved yet.

Can I legally be written up for this?
