I have two questions for which I need your help...
(1) The H1B from my present company expires in 2 months. My company attorney just filed the H1B renewal application. I recently got a job offer from a different company. Since my current H1B visa is valid for only 2 more months, if my new employer tranfers my H1B visa to their company, do they also have to renew it immediately?? or can they combine both those in 1 application. I mean, when they transfer my H1B, can they request it for 3 more years? (2) In November of 2004, my present company applied for my labor certification through Reduction in Recruitment (RIR) process.... and the application was sent to the Dallas backlog center. He says that I will get the labor certification in another 1.5 years. If I move to the new employer, is there any chance that I can transfer the labor certification from my present employer to the new employer? or should i start the green card process all over again? Thanks in advance for your help. Sankar |
