My father had a portion of his land taken by our school district through eminent domain. The school district made a quick claim by saying this land was necessary to build a new Junior High. When this happened 40 acres of my fathers land became land locked. The school doesn't want to give him easement to his property by crossing the street. Instead they are saying he can go down another road and gain access through my brothers property. This is way out of his way to take his farm equipment down a busy road, when he could cross a private school driveway to gain access. He just had a judge hearing on Jan 31, 2006 and the court didn't have a precedence to rule. Is a land owner able to get easement or right-of-way through an eminent domain seized piece of his property? I would like to know if any precedence has been set by other similar court cases or how would I find out.
