Hello!
I am trying to get legal advice on what my rights are regarding the home (I thought I owned) I have lived in for the past 9 years. My husband could not afford the downpayment, so his mother assisted with aprox 30K to buy.. and she put the title in her Trust. She got the mortage since my husband has bad credit. I had no say in any of this including there was no legal statement as to what happens after her death (she is 84) and as it stands now.. it could be split 6 ways due to his siblings. I have been trying to get my husband to resolve this matter with his mother for many years to no avail. We are responsible for paying the mortgage which comes to us, and the real estate taxes, and insurance as well as all upgrades and home repairs which are considerable. We have no lease, so I dont even know my status here since I was under the assumption we would be protected as owners of this house since it IS his mother. She claims she owns the house.. we do not have any payoff amount she will agree to. I would like to know what my legal rights are considering this situation which causes extreme stress on our marriage.. which is also in peril. I have 2 sons under 18. Anyone want to take this on?
