Default Another Hoa Nightmare

I live in a Property Owners Association, a community governed by CC&R's & The Davis Sterling Act. Many of the members of our community are outraged by the actions of our current Board of Directors.

We have exhausted all avenues as far as self help that we can find. We have submitted 2 petitions ( by different groups) calling for a "Special Meeting" to Recall the Board and force a vote for all New Directors.

We have followed the letter of the law and submitted more then the required # of signatures to start a recall (simple majority 5%) which in our case is 102 signatures. To date we have submitted the signatures of 182 "Members in Good Standing" and they still have excuses and blatantly refuse to resign.

The attorney representing the Homeowners Association stood at the podium in front of the Board meeting last month and told the members who have been asking for his assistance that he is not their to represent the Homeowners. He's there to represent the Board of Directors! yet we are the ones paying his bills.

Is this appropriate?

Some of the Board Members have stated they will not step down no matter what we give them.

What can we do?

Looking for any/all advice we can get. Personally I think we need one hell of a bulldog Attorney. That being said I realize the importance of mediation / arbitration and we are willing to explore all possibilities. Thanks for your time and help.
