Here is my question; a water company agreed in writing to hand over to a group of homeowners a large lot; I have a written document to this extent from the water company.
They promised on writing to record this with the county recorder. Should i file a 'les pendes" to tie up the property, or a breach of contract. This water company is now preparing to sell this property? |

Depending on what your state requires you need to file whatever document that will stop this sale. Whether this document is an injunction or les pendes you will need to talk to your court house. If for some reason you cannot stop the sale then you can proceed with your breach of contract claim including all damages resulting from the sale.
If you are able to stop the sale you can still sue for breach of contract for all damages you have incurred in stopping the sale etc. |
