Grace you are saying this is Civil. So should I have been arrested? They arrested me on criminal theft.

Is a contract that is not signed by the landlord/rental agency valid? Does the Rental contract become valid after it is signed by the lessee or does it have to be signed by both lessee and landlord to be valid?

My trial finished up yesterday.

The judge found that I was Not Guilty!

I am happy about the verdict, but I do feel that I paid a high price to save my reputation.

The Judge said the case was interesting, but Goofy.

The officer that arested me and roughed me up is no longer on our Police Force. I don't know why, but I am happy that he will not be out there taking matters into his own hands and punishing people before he is sure they are guilty.

His job is to arrest, not to dish out his own punishment/pain to those he thinks did something wrong. It is up to the courts to hear the whole case and decide on guilt and punishment when necessary.

I did not resist the Officer in any way. I did refuse to discuss the case with him, which is my right. I asked for an Atty to be present, before I spoke about the case. In all other ways I cooperated fully with him and others.

I was not treated with dignity, my arms were injured by this man. I believe he used unreasonable force on me. I was processed in 20 minutes or less, yet they held me for four hours and made me use a filthy toilet where a male prisoner was located. I saw only two Officers that were professional on their jobs one was a woman and the other was a man.

I have prior military, I served two tours with the USAF so I do know what Professional standards are.

Thank you for all of your support and wisdom Gracie. BTW, The contract was not signed by the management company, so they cannot come back on my son for any sublease or problems relating to the sublease.

My son did learn a big lesson and he has found a good job and is working everyday. He went and hired a lawyer to take over his case, as the Public Defender did not council him on anything. She did not really discuss anything except for telling him to take a plea. She has never heard his side of the story or looked at any of the evidence we provided her with.

So my son and his new Atty go before the Judge next week. The lawyer thinks the Judge will find him innocent also. He thinks my son and I have provided some very good photos and other information. The cop that charged my son is no longer with our police department either.

So thanks for everything, will keep you updated!

This certainly is an interesting case. This thread should remain open---they usually do unless the dialogue turns insulting or vulgar. So far that hasn't happened. Please keep me in mind--I look forward to hearing from you.
