Default child vs. public school playground equipment

my 7 yr old child was at recess playing on monkey bars (which the teachers allowed). The monkey bars are missing 2 rods at one end and 3 rods at the other end. When my child (adam) fell from this equipment he broke both bones in his right forearm.

Is there any legal action i have or are there laws in place to protect public schools in cases like this?

What is your State name? Where did this occur? When did this occur? How old is your child? What is the relationship/cause between your child's injuries and the fact that "The monkey bars are missing 2 rods at one end and 3 rods at the other end"?
