Unhappy Slip & Fall at Hotel

My husband just finished taking a shower. I walked into the room and slipped and fell. At first I thought I broke my finger but it was just jamed very bad. My back and shoulder hurt and my wrist was sprained. This was a handicap bathroom and there was no lip around the shower area. There was a slight elevation change but the shower curtain is bowed out at the top past the elevation change. The shower head is not mounted at one of the ends, it is mounted on the back wall and aimed toward the shower curtain. When you have the water on it hits the shower curtain and runs into the middle of the room. This was our first day of vac. and we spent most of it at the Med Center. Needless to say it really messed up our vac. and the hotel was a jerk about it. They would not take any responsibility and the hotel manager would not even talk to us. When I got back to work it has been very painful and slows me down. What can I do?

This is a tough one. I would assume the hotel provides bath mat towels that are typically used on the floor to step on once out of the shower. They most likely will argue that had you used one of these there would not be an issue.

Did you know that the water was running onto the floor because of the shower curtain issue?

Best bet is to take this to an attorney in your area and get his/her opinion.

My husband was on the towel. I had just walked into the bathroom. And it was our first morning there, so no we did not know there was a problem. There is nothing to step out of, the floor is flat all the way accross, except for a small line where the elevation changes.

Is it safe to assume the bath mat was soaking wet if floor was wet?

Yes, I'm sure it was. Are you saying that would keep them from having any responsibility? Thanks for your help. I'm just tired and sore all over and angry for being treated like they just don't care.
