I Need To File A Complaint Form, Can I Obtain A Complaint Form From Any City Police Dept.? Or Obtain A (free) Complaint Form Online And Mail It To The City Police Dept.? (too Afraid To Go To Police Dept.) Does A Complaint Form Need To Be Filed Before Filing My Lawsuit Claim? Do I Need To Include A Notorized Declaration, Of Complete Details Of The Incident When I File The Claim With The Courts? Or Can I Wait And File Declaration When I File Hearing Order After Claim??? You will need to file a claim with the City's Risk Management Department prior to filing against any governmental/city agency. Once you file a claim, if they deny the claim they will send you a "Right to Sue" letter. Then you can proceed either in small claims court (unde $5,000) or civil court.
To get this form you can either call the city and ask for the number to their risk management department or you might try your local courthouses small claims advisory. They might have the information that you need. As for the step by step procedures you will want to consult an attorney regarding the appropriate paperwork to file etc. Service on the city, county or governmental agency is also quite important.
