I have belonged to a fitness club for the last several years. During which time they have attempted to take my photo and put it into their computer. I explained to them that I do not want my photo in there computer. I also informed them on numerous occassions that if they need to see a photo of me before I enter the gym facility, I would show them my Drivers License (which has my photo on it). Just recently, the gym facility was bought out and they are now requesting that they take a photo of me. In fact, they actually took a photo of me (side shot) without my permission and put it into there computer. I have asked them to remove it, but to no avail. I have also informed them that if they need to see a photo of me before I enter the facility, I would show them a copy of my driver licenses (photo included). What course of action do I have.

If taking your photo for a gym card or for their records is what is required to have a gym membership there then you are out of luck. This is most gyms policy. This is how they make sure that you are the one who originally signed up for the membership.
If you don't like their policy you can always go to a different gym. Otherwise you are most likely out of luck. |
