considering purusing battery lawsuit...need advice plz

I was recently a vicitim of assault and battery. it took place in a crowded restaurant where both me and the defendant were engaging in under-age drinking. Due to those circumstances i didnt press charges, in order to save my ***. But now, id like to file a lawsuit against the other party and pursue compensation. would this be a wise choice? any advice?

If you have expenses, such as medical, as a result of the assault and battery then you can sue. Remember the judge will take into consideration that you both were participating in underage drinking which may mitigate the other parties damages meaning that the judge may or may not award you the full amount of the damages because you will both drinking.
