Injured @ grocery store

I recently had the tip of my finger sliced off while attempting to pick up a twelve pack of beer @ my local grocery store. There was a broken bottle inside and it sliced my finger when went to clasp it. I had to make two doctor visits, which totaled 3 hours of wait time, and was unable to give my 10 week old son a bath or change his poop diapers for fear of infecting the site.

I was offered $200 + my co-pay today from MAC risk mgmnt, who oversees liability for the store. Now, my question is, is this a fair offer or should I pursue more from the beer distributer? I feel that $200 is a pretty low amount, considering the time wasted at the doctor, not being able to sleep because of a throbbing finger, etc.

What should I do?

Maybe if you point out you could NOT HOLD YOUR BEER, they would offer you more??

Seriously, asking for damages because you could not change a diaper isn't reasonable---wear gloves. You want to recovery money for having to wait in the doctors office?? Isn't going to happen.

Recovery is customarily based on negligence. It is virtually impossible to prove WHO broke the bottle, as well as who would be negligent. What if a customer had caused the breakage? Is it fair to sue the store? They do not customarily walk around checking hourly for broken bottles.

Of course, this is America--you can sue anyone for anything so finding an attorney who is willing to talk a third of that two hundred dollars wouldn't be hard.

If you had suffered any permanent damage or nerve impairment, then perhaps you could recover. But in the absence of negligence and/or a permanent injury, I feel you may be out of luck.

Wish I could tell you otherwise.
