Default Insurance company wants cut of settlement

Is this legal?

The insurance company wants a cut of my settlement...
which in some ways is reasonable, but not how they're trying to get it.

I paid into my insurance for about 2 years, it probably equalled $2000 when I had my accident.
The accident ran about $15,000 in expenses, but insurance only had to pay about $3000 due to the "insurance rates" they get from the medical community...
which is dramatically lower, as you can see.

Well, my lawyer is telling me that they want $15,000 from my settlement.

When in reality, they should be getting $1000 to cover the difference of what they paid out, over and above my contribution.
They're trying to claim "non-insurance rates"...they didn't actually PAY that much, but that's what they want from me!!!

Is this legal?
