Default Restaurant injury - foriegn object in food.

This is my first post. I was injured in early November while eating in a local well known restaraunt. I took a bite of my clamcake and choked on a piece of wire that was 5" long. It was partially coiled inside the clamcake and partially uncoiled. I have been sick every since! I sustained a gum infection because the wire pierced my gums and I also have 3 chipped teeth. I need some guidance. The Manager wrote an accident report, the company acknowledged the accident, the insurance company came to my home and acknowledged that they have the piece of wire...which was doubled with barbs about every quarter to half inch. They confirmed that the wire was indeed 5" long and came from a fryer basket, but said they cannot find the basket in the restaraunt. They wanted me to give them a figure as to what I was "Looking for"! I want to know how this happened. They said it was a little accident! I said it was negligence on the restaurant's part in not inspecting their equipment! They sent letters to my Dr. and Dentist acknowledging the accident and offereing to pay for all medical. Please advise as to what steps I should take next. Were they obligated to file this accident and report it? If so, to whom and in what time frame? How can I find out if this was done? Thanks!

Whose insurance company came to your home --- your own or the restaurant's? Also, rather than asking what you should do next, what do you *want* to do next? This will go a long way in determining what is and is not an option at present...
