Default Taken advantage of by Recruiter

Hi, I am hoping someone will respond to let me know if they think I should hire a lawyer. My daughter is 17 and is considering going into the National Guard. The recruiter(not her normal one) that took her to take her ASVAB test ended up having personal conversations with her and within 24 hours he had picked her up at school(in uniform and the Guard van), took her to a motel and had *** with her after giving her Tequila. She did go willingly but she is also 17 and confused about life in general. That's why she is considering the Military for some direction and discipline. Afterwards he took her back to school for dance practice and then picked her up again and went back to the motel for round two. When finished he took her to a friends house and left her with the booze which she proceeded to drink more than half of the bottle and passed out. The DA has pressed charges but it looks like they are going to only give this 35 year-old married man(who told her he was 28 and single) probation and he will NOT have to register as a *** offender. I am livid at our Justice system at the moment. He was originally charged with 3 felonies and 1 misdemeanor but they made a deal to drop 2 counts for his no contest plea to 2 counts of felony unlawful *** with a minor more than 3 years younger. I would appreciate any responses you would like to offer. Should we consider suing the Guard, the perpetrator or both? Or neither? Please help!!!

What were the reasons given as to why he isn't going to be required to register as a s3x offender? Why isn't he being charged with statutory rape? Did you have an attorney for the criminal proceeding? ( Not that you needed one since you weren't charged)

I would talk with an attorney immediately, one who specializes in civil law, in particular, how it pertains to the government. I believe you have a case against not only the perpetrator, but possibly against those in authority who hired him and put him in a position of authority IF you can prove they did so negligently.

Very sorry this happened.
