Default Hunting accident

I was involved in a hunting accident on Seot. 4 2004. I was shot in the right eye. I can only differentate between light and dark out of the lower half of my eye. I was shot at the place where I work(catfish farm). I was not on the "clock" but I was to work soon after hunting was finished. This is an employee only type hunting situation. The farm manager (not the owner) is the one that shot me. Is there anyone here that has this type of hunting accident experience? Any other comments are appreciated.

Yes. Surprisingly, many of us are shot in the eyes by our managers at catfish farms.

Did you have any other questions?

I guess I thought that you could read between the lines. Is there anyone here that has had hunting accident cases? What do ya'll recommend as a course of action(insurance suit)?

I left my crystal ball in the repair shop. Sorry, but I'm not into clairvoyance or tarot card reading. Next time, in your initial post, as a direct question and don't make us guess!!

It doesn't matter if it's a "hunting accident" or a "vehicle accident" because it all falls under the category of "negligence." Your manager had a legal duty not to shoot another human being, just like I have a legal duty not to go through a stop sign and broadside another vehicle. Same thing, different method of injury - - but it's all negligence.

So, since you weren't "on the clock" this isn't a Workers' Compensation Claim. It's strictly a claim against your manager, and your catfish farm owner, and their respective insurance.

One question though - - what in God's name were you guys "hunting" on a catfish farm? Was this in Louisiana? If not, what State?

See a local Personal Injury attorney.

There are many things to control on a fish farm but we were dove hunting on ponds in Arkansas. Will any personal injury attorney work or do I need a "higher priced" one? Is this just an insurance case or is there a personal suit here? I do not know what amounts are carried on insurance polcies for this kind of thing, but I am 25 and half blind for life. This has messed up my career.

Any Personal Injury attorney will do. You don't need a "high-priced" attorney because this isn't a Constitutional matter. It's just a personal injury matter; something that happens every single day - - not like yours, but negligence happens all the time. People are careless, and accidents happen. Also, any personal injury attorney will take this case on a "contingency" basis - - which means, you don't have to pay one, thin, dime UNLESS the attorney is able to obtain a settlement or judgment for you. Then, the attorney takes anywhere from 33 to 40 percent of any such settlement or judgment. You don't pay.

That's a strange question. If you and your attorney make a claim against the employee and the catfish farm owner, then most assuredly they will each try to get their insurance companies involved to defend them and to possibly pay a settlement or a lawsuit judgment.

You don't need to worry about this. Your catfish farm owner is the "deep pocket" and he shouldn't have allowed the "hunting" on his property in the first place!

Well, we all spin the Roulette Wheel in our lives. Some of us hunt, and some of us drive vehicles. Accidents happen. Your accident just happened to have occurred on catfish farm - - but, it could have happened on the open highway. That's why they are called accidents. I'm sure your friend didn't mean to shoot you, but he did practice unsafe shooting, something that he will have to pay for because he was negligent.
