i was a victim of a battery from 2 different guys, i was beat up in a parking lot about 6-8 months ago. i knew the guys and filed charges with the city prosecutor, one of the guys was ordered to probation, drug and alcohol classes, and a restitution payment of $215. the other guy was just picked up on his warrant and is now in the process of being prosecuted for battery. My question is could i file a lawsuit against these guys for emotional trauma and what not? maybe even in small claims? the only thing the restitution is paying is my co-payment at the ER and a missed day of work. had i not had health insurance the bill would have been $7,000, but my insurance picked it up. would greatly apreciate any advice.
