I have a friend who has been married for 5 years, the husband was brought over here from another country and they now have a young child. The husband has recently (< 6 months ago) received a Green card and has now decided he wants a divorce. We believe he had intentions from day 1 to marry and divorce as soon as the Green card arrives. Now that he has a green card, is there anyway to void this in order to have him deported? We believe the marriage was a scheme for him to get into this country and nothing more. Any advice would help. Thanks.

I agree with the previous posters. However much you think the guy deserves to be deported, it’s not worth the effort. He has a kid that needs a father. You said nothing about abuse so I’m assuming he is a decent father. Plus, it will be almost impossible to prove a sham marriage after the fact. Especially since your only real argument is that he had bad intentions. That’s a question of his state of mind and only he can really speak to it in a court of law. After all, it sounds like he was convincing enough about his honest intent to be married for 5 years…
