I purchased a home and property in Hawaii of which I have had a mortgage for the past two years and found out recently that the title search company failed to disclose in it's report that there was a lien by royal patent grant to the land. Do these royal patent grants truly exist and does it mean that the purchase of this property is void if an heir to the original royal patent grant were to make a claim?

Apparently there are several land grants that may have heirs and assigns out there somewhere. They usually do a search in genealogy records and for the appropriate surnames, take notice of these folks to court, post the property description in the paper and demand that anyone still living with claim to the property show up in court of a specified day to show cause why the court should not grant the ownership to the buyer.
It is something YOU should insist that the TITLE COMPANY should do. If you lose title, then you get to sue the title company if they don't pay off based on the title policy. |
