How do I claim the equity from my foreclosed and auctioned home?

My husband, and I had a home in Florida, and he, took responsibility for the payments etc. I didn’t know that, at some point he wasn’t paying the mortgage, and when I found out, it was to late to save it, and in fact he didn’t want to. So they auctioned it off. Now, I am receiving letters and phone calls from organizations that are telling me that, since we had the home for so many years that we built up some equity in the home, and that they can recover the money for us, or it will go to the State.

My question to you is, are these companies legitimate, and/ or how can I find a legitimate company. I am being bombarded with these letters from different finders. We need the money to help pay bills, so I would like to receive the money. I just don’t know who to trust with our money. Please, find below (with the names omitted) one of the letter’s that I have received:


Dear BarbieAnn54,

(Name Of Company) , Inc. is in the business of locating unclaimed assets and working with their rightful owners to claim them, strictly on a commission basis. We make money only if we deliver funds to you; therefore, when we write to you, it is because there is a real opportunity to recover funds.

It is possible to recover money for you from your foreclosed property in (said county). We would like to work for you in recovering these funds. Included please find our proposed agreement to start the recovery process. Please notice that there is no cost at all for you unless we are successful; that all funds are handled strictly through an attorney’s professional trust account, and that the money will be sent to the person and location designated by you on the attached agreement.
Please sign, fill in name and address of person who will receive the funds, and send the document back to us at your earliest convenience. We have included a self-addressed, stamped envelope for your prompt response.

For additional details about this case or to schedule an appointment, please call us as soon as possible. My direct number is ……123-456-7890. We look forward to the opportunity of working with you.

Here is the Recovery Agreement Below:

Name of company, Inc. hereinafter “Finder”), and BarbieAnn54 (hereinafter” Claimant”), agree to the following:

Claimant hereby appoints Finder, in the person of one of its principal officers, as lawful attorney-in-fact to seek recovery of unclaimed funds (derived from ….County foreclosure case), that belong to Claimant, hereby revoking all previous powers of attorney to whomever granted. This power of attorney grants to Finder authority to do whatever is necessary and proper to recover the aforementioned funds only, as fully as Claimant might or could do. This includes, without limitation, recommending legal Counsel to conduct all matters that require licensed professional attorneys in the State of Florida. Said Counsel will be the legal attorney for Claimant, and is hereby granted authority to receive, endorse, deposit, negotiate, and disburse any funds received in this recovery action as per other sections of this agreement. Counsel is to represent the interests of Clamant at all times.

In consideration of Finder’s successful efforts in locating and notifying Claimant of funds yet uncollected, and based on Finder’s promise to perform to the best of its abilities as prescribed herein, Claimant hereby agrees that if Finder is able to recover said funds thought Counsel on behalf of Claimant, then Finder shall be entitled to a fee equal to forty
percent of net amounts recovered. It is understood that:

1. Unless funds are recovered and delivered, there will be no charge to Claimant whatsoever.
2. Finder will advance any and all costs needed to advance this action on behalf of Claimant.
3. Counsel will instruct the holder of funds to make checks payable to Counsel’s Trust Account. Upon receipt of the check, Counsel will process the check, and forward the Finder’s fee as agreed above. Claimant’s share of the funds shall be forward to:

These are NOT legit companies. If you were due any money from the sale of the house, you would have received a check from the respective mortgage company. ANYONE that you have to PAY to give you YOUR money is a bad idea. PERIOD.

DONT DO IT.

Also, ( and this is irrelevant to the 'missing money' issue) you say YOU BOTH had a house. Then you put the responsibility on him "HE DIDNT PAY". If the house was deeded to both of you, whether or not you knew what was happening, you are responsible. Same as the taxes you mentioned in the other posting. If both of you were on the note, or even both on the deed ( and just him on the note ) you are both financially and legally responsible. So, you cannot as a matter of law say "it was his responsibility and he didn't pay", then change pronouns and say YOU want to collect the equity. You aren't entitled to equity in a forclosed home. Neither is he. Why would the bank give you back what you paid into the home or the difference between what it is worth and the note amount? The wouldn't. Those "offers" are hoaxes.

If you want to see if you have unclaimed money ( usually from tax refunds, security deposit refunds, etc <not foreclosed house equity checks!!>) check yourself. Every state has an office for this and here is yours: (Also, try GOOGLING the name of the company that sent you the letter and write HOAX in the search box and see what comes up).

Hello,

That is a scam designed to get all your personal information. You give it willingly thinking thay will help you. Many times you pay a fee for their services. The next thing you know the IRS is after you for unpaid taxes on ten jobs you didn't know you had. Send those letters to the FBI and your states Attorney General.
