New York - Landlord not delivering property

I paid nearly $2925 security deposit and $2000 first month's rent. Lease has not been executed. Landlord was to deliver property on 6/24/06, but left a message telling me he won't deliver until July 2, and hasn't returned my calls.


Due to previous committments the "landlord" is aware of, I am not available to move between June 25 and July 15. As a result, I'm incur hotel bills, double moving charges, and storeage costs.

What is my recourse?

That depends --- you may have ample recourse, you have none. It all depends on what was in your lease contract, or any other *signed* agreement elucidating the terms of your lease. If nowhere in these contracts it was stipulated that you would have access to your leased property by June 24th, there's little you can do...
