Eviction by false representations in an unlawful detainer action
I was evicted out of a home I owned since 1979 and lived in for over 20 years when the Trustee hired a law firm and falasified the deed. She then hired an attorney for an unlawful detainer action stating that I signed a rental agreement and failed to pay the rent. There is NO rental agreement and I am the legal owner of the home.
I was denied even so much a 60 day move out. I was thrown out of my home without notice with only the clothes on my back by the Santa Barbara California Sheriff's Department, Sheriff Drinkwater, who failed to verify the validity of the eviction and that there was NO rental agreement in this action.
I was not permitted to come back to my home to collect my belongings or my pets. I was informed that I had to have access to my home within 15 days. Instead the trustee took some of my belongings she did not want to convert to herself and threw them into storage lockers. I was then extorted for money by her attonrey James Nichols stating that if I did not pay for the first month rent on the storage lockers, my belongings would be taken to the dump. I had to pay approximately $400.00. The storage cost was really $25.00.
What are my legal rights? I have been told that filing had to have the rental agreement attached for an eviction. That the Santa Barbara, CA Sheriff's Department cannot evict me without this contract. That the trustee has to make a full inventory list of everthing she removed from my home and took to the storage lockers.
Now I am told that the $400.00 I paid was for rent for my own home when I was denied to come to my home and remove my belongings---which would have been the entire home.
I have read that I am permitted damages of $100.00 a day!
What are my legal rights?
