Landlord Liability of Parking Premisis

Sunday March 19 I discovered My car's entire hood had been tagged/keyed. Can I hold the lanlord liable for the damages?


I live in a medium apartment complex consisting of security parking access gates which are only accessible to tenants who have the parking gate key (for which a 35 dollar security deposit is required). The gate is regularly open due to malfunctions. I believe the landlord failed to provide the basic security for the complex which caused my car's damages.

I think this is a good argument. As long as you can prove that the gate was not functioning at the time the incident occurred and that the landlord knew of the issues with the gate I think you may prevail. Depending on how much the estimate are this may be a great case for small claims court.
