Angry Breech of Lease

My husband and I were looking for a house in Virginia Beach. We finally found one. The Landlord was pleased with us and asked us to come back to meet his wife. We returned and answered all their question. We provided them with a credit report that I had pulled for my husband, I explained that my credit was bad because of idenity theft. They were fine with it. They asked for our landlord info, which was given to them along with an application for the house. The owner said the application was for personal use only. It was then decided that they wanted us to sign a years lease with terms. We all signed the lease the terms were as follows $250.00 pet deposit at time of lease. This was given to them. Pro-rated rent and half the deposit due at time of move on and the rest before the 3/15/06. These terms were added after the signing of the lease without my husband and I knowing. He wrote them on the bottom of the lease. We were fine with this. We also decided to allot the rent from my husband's paycheck. So they would have received 637.50 on the 5th of Jan and the 19th of Jan this would have been for Feb rent. Again they were happy with that and said that this was going to work out well. So We thought everything was ok. We answer all their questions and away we went. I then gave my current landlord a 30 days notice to vacate and started to pack the house. Today I find out that they don't want to rent to us. To many misunderstandings and was told that they talked to a lawyer and that they didn't have to rent to us. No reason why. This happens almost 2 weeks after signing a lease. I have no where to go or live. Since the house I am in will be rented. I have to start from square one and I want to know if this is legal. How can they back out? This is a breach of contract and now my whole family is suffering because we have no where to go. We all are crying and upset as we sit in our house that is packed and ready to go. What are my legal rights. There is more but is says be brief.

Without having any of your information in front of me I would say that it sounds like they are in breach of the lease. I would take them to small claims court for all damages you incur such as renting a storage facility for all your belongings, nights in hotels while looking for a place etc.

What about the emtional distress it has cause my family. I have 3 kids that are affected by this.

Most, if not all states, do not allow emotional distress arguments for breach of contract cases.
