Default Do We Have A Case

Brief background on my situation. I own a business in a brand new strip mall. Prior to construction, the landlord had verbally, but not in writing, said that a major tentant will anchor the shopping center. There are 3 buildings in the center, of which this major retail tenant will take about half of the largest building.

A year later, after construction and after all the shops have been filled, there is no major tenant to draw traffic to the plaza. Pretty much all the tenants are suffering and we are wondering if we can go after the current landlord to reduce rent or terminate our lease early without penalty. The landlord that built the plaza, sold it 4 months after it completed. There are 4 other tenants that were told verbally that a major tenant would anchor the center.

If this clause is not in your lease agreement landlord will state that he/she never told any of the tenants this.

All you can do is try and have your rent reduced....
