Question Do I have a lease or a month to month?

I signed a residential lease to rent a unit in a condo in July 2005 that expired July 2006. My landlord mentioned a couple times that I should sign another, and I agreed to sign it whenever he sent it to me, but he never did. I just kept paying the rent. Now I am thinking I might like to move out and buy a home instead. Do I have another year lease because I kept paying, or am I on a month to month? I checked my (expired) lease terms and the condo pamphlet I got when I moved in--neither says anything relating to an automatic renewal or rollover. Do I need to go to a lawyer about this or is there a simple answer? Note: this is in Virginia.

Simple. You're now a month-to-month tenant. You must still abide by all the terms and conditions of your lease; but, the only thing that has changed is the length of your tenancy which, like I said, is now a month-to-month tenancy. For example, you must still give the requisite amount of "notice" prior to your move, if stated in your lease. If not stated, then the amount required by State law.
