Usage of Images on Internet

Hi There

Is a website with a content format like this one linked below an infringement of images copyright or it falls under fair use as an illustration and commentary?

Top 10 Greatest NBA Players of All Time. Sporteology

I'd do a similar work, citing sources. Please note that my business resides in the UK but images are usually from the US, i don't think it matters but just to be more precise. Many thanks for your advice

Usage of Images

When you use images from other websites, it could be copyright since you are using the images they created.

There are many websites that have images available that are in the public domain and the website allows viewers to use and upload the images. With public domain, you can use the images in any way and would not be violation of any laws. Check the terms and conditions on the site to determine if the public domain allows you to use the images.

In the US those images would probably be considered fair use, especially if there is no financial gain due to the use of the images. However, as you reside in the UK, it is important to know that the UK has much stricter copyright laws than the US. While it is called fair use in the US, in the UK it is called fair dealing and governed by Copyright, Designs and Patents Act of 1988. The CPDA allows for "fair dealing" of certain materials under copyright in very limited circumstances. If you are using copyrighted images as part of a business, most likely you do not fall under any of the fair dealing exceptions. However, it all depends on whether or not someone with a copyright wishes to press their claim against you. It might be best consult with a UK attorney about whether you should take any steps to protect yourself in the off chance you are sued.

Some images in the web are protected by a copyright. If it is possible just copy images from image hosting site that allow reuse of such images.
