Default Married to non-resident alien

We've been married over a year now and have a 3 month old daughter, and recently my wife has been threatening to take our daughter back to her country of origin where I won't be able to find them. When we got married, she made it clear that she did love me, but also wanted to expedite the process of getting her green card.

The reason she has been making this threat is because we haven't started the paper work for her greencard yet. Our budget is tight with the baby, but I've come to the realization that there was love on my end at the beginning, but not on her end.

My first question is, what recourse do I have if my wife leaves with our daughter, and what preventative action can I take to make sure my daughter remains a part of my life? I don't want to seperate a mother from our daughter, but as she isn't concerned with taking me out of the picture, I need to be ready for whatever unsavory course this may take.

My second question is, what consequences could I face for being involved in a fradulent marriage, considering that I was under the impression that we married out of love?

Default You are holding the cards.

Your wife cannot take you daughter out of the U.S. without your permission. I assumed you are a US citizen? and your daughter was born in the US? That makes her a US citizen.

Nothing is going to happen to you if you married for love. Unlike if you knowingly married a non-resident just as so she can change her status to be a legal immigrant or to become a US citizenship by naturalization. Were you paid or promised to be re-imbursed once she gets her green card?
