confuse?

Me & my husban came to United state on aprill 2004 and my kids came on may 2005, we want to apply for assylum but we make a consultations to two lawyers in a different state. in PA they said i have to apply assylum before guest worker program begin but in CA they said i have to wait till guest worker program begin becouse there is no chance for us to get the asslyum. so what should we do? if we could we dont want going back to our country its to much pain for my family.
