I've been dating this girl for 8 months and we split up. Our apartments. share an interior wall with no insulation in it. She then invites male friends over a few days after we split up and they are making a LOT of noise. So I bang on the walls yell **** a few times then yell hey Kelsey(her child's name) your mom is a ****.
She apparently wasn't amused since she filed for a restraining order for "pounding on the walls and yelling." Papers are served to me at 5:00 on friday night and I had to be out of state the following week for training and had to leave on sunday. So i can't attend the hearing. I wrote a letter to the presiding judge for an adjournment to a later date and he has to get the petitioner's approval to move the date.....WTF? Yes they asked her would you like to have the hearing at a later date or automaticly win? So I have a restraining order on me now and no criminal charges what so ever. Do I eat this one and chalk it up to life experiance or drop a couple grand on a lawyer to fight it? The state that I live in has an open access to legal info on the net and anyone who is courious can get that information. Even if the order is removed I believe the internet copy of it still will be available, labeled a stalker. I have some serious issues about the system after dealing with this and damn am I glad I don't have kids or financial investments with her. It's like done and over but should I still fight it? |

I don't know where you live but here in Florida there has to be 2 acts of violence within a 6 month period in order to get a restraining order. And when one is granted you can not come within 500 ft of that person. I would check in your state because if she gets one you may have to move out of your apartment. Because if you violate the order and come within 500 ft you could be sent to jail. If you don't show up in court I think would be the worst thing you could do. Pat |
