adoption
From personal experience this last year. My husband allowed for the step father to adopt his daughter. It was consentuall. From start to Finish it took about 90 days. The state that the child live in supposely did a background check on the step father to make sure he wa financially , emotionally, mentally and physically able to take care of the child. It was approved and the adoption was granted. Within a month of the final paperwork being filed. Not only was my husband's duaghter, but also the little sister that belong to the step father were removed from his care by the state while the mother was over in iraq on a tour of duty. Mother had to come back and get custody back from the state. So much for the state dong thier job.
In another case involving my friend. Which sounds alot like you and your new husband. My friend hired a attorney and drew up the paper work. The father of her child has not had anything to do with the child for over 5 years. No child support paid, no visitation given by the court due to drug and abusive issue. Full custody given to my friend. Sent the adoptin paperwork to the last known address. He responded back that he wasn't going to allow the step father to adopt. My friend jumped through a few hoop. The bio father then decided not to pursue the case anymore. But didn't sign over his rights either. My friend stayed patience, After almost twos years. The courts granted the step father the right to adopt because the bio father showed no interest. The court appt the bio father a Gaurdian ad litem on his behalf to make sure that they didn't take away his rights immaturely. After a desitnatted amount of time. The GAL had to report back to the court his findings on the bio father. Because the bio father wouldn't return his call or anything. The GAL returned a report that the adoption would be in the best interest of the child. The adopption was granted. It may be an up hill battle. But where there is a will , there is a way. Good Luck.
