Exclamation HELP ~ Kidnapping should be the word!

Married 11 yrs had a non-violent (doesn’t hit) dispute after hubby arrived home from the Company Christmas Party. Feelings were hurt, he went straight to bed – both now realize he said some weird things in his sleep. The situation was blown way out of proportion. Children were not @ home, gone for the nite. They heard some arguing but it was minor. He Contacted NCP for mutual agreement temporary custody. She wrote the agreement and included: due to separation (which we were not), and pending divorce (we had not discussed) as well as the unfriendly environment, for and undetermined amount of time. Husband signed it due to his main concern of us completely puzzled over the ordeal and not wanting the boys to be around it since this is the only stability they know. We were able to realize the misunderstanding within days – he called NCP 8 days later & informed everything was great, he would be in MS that weekend. NCP said OK but called 2 days later, left voice mail refused to release since he did not divorce me. I knew of several occasions, but was informed that her attempts & comments about getting back together have persisted for the entire 11 yrs. Correspondences from the summer state she is broke the same day she is paid, she hasn’t paid on the boys medical for almost 2 years, behind on C/S, Ins., and hardly ever called or exercised visitations – I feel it is strictly financial due to AG calling 3 days in to her having the boys for money, she didn’t tell them it was an agreed temporary now Interference situation. Also there is definitely some mental abuse– all was great during transfer, kids showed husband love, took a picture, talked to him on the phone but when he went there 2 weeks later, the one he saw was terrified of his presence, spoke of police and hid behind a staff member, I noticed this after Thanksgiving as well. They need counseling immediately! Informed the agreement is not binding, MS will not enforce although a revocation was served, & the DA will not file & said not to call but have. It has now been one month. No Christmas, no calls, won’t answer calls, or emails and it is Primary Custodial Parents possession. True the Haitus Corpus takes 120 days before the court date? Can you explain a Writ? How do we get them back ASAP before the emotional abuse becomes to far gone?
