Erisa and LTD

My documentation about LTD through 6/30/10 indicates that benefits were non taxable.

At the 2010 renewal the words non taxable were removed from the 1 page summary info given to employees. However, I never received a notice that the taxability of the benefits changed.

My understanding is that the plan is setup with SunLife as non taxable but because employees are paying the premium the benefits are taxable.

Do you feel that I would have a plausible case against my employer if I went on disability and sued them for the financial impact of taxing my benefits?
