| Discrimination of foreign workers under H2B visa Hello everyone, I am currently working for a company which operates 13 restaurants in DC, Maryland and Virginia. The company hired like 30 people from foreign countries on H2B visa and we all came here with high hopes. I do not want to go into a lot of details so I will cut the long story short. We paid thousands of dollars to arrive in US and now being here we are working in unfair conditions. We had no accommodation provided, no transport and the little money we came with finished very quickly. We stayed 1 month without a job and the only check we received was a few bucks for attending the company orientation and 5 days training. When we started we were not on equal bases with the Americans working in the restaurant. Our working week is 20 hours and the type of visa we have does not allow us the undertake another employment legally. We are given the worst sections in the restaurant and we were never given evening shifts which pay a lot more the day shift which is only 1 hour work for lunch and the rest is sidework benefiting only the restaurant but not us. To give a slight idea of what I mean: The transport to the place I work cost me 7 dollars to pay METRO bus and rail per day and I walk out of the restaurant on average with 20 to 30 dollars in tips. While an american server will walk out with 50 to 100 for the same lunch simply because was given better section and the host are seating them at all times. After I minus the transport expense I am left with 18-20 dollars which have to pay for my accommodation, food,phone bill and everything else. We also had to buy our own uniform. On top of all we have been constantly criticized by the management for underachieving which is totally untrue and unfair. If anyone is capable of giving some legal advice and had the patience to read tru my whole tread - PLEASE help me because I intend to take this company to court. I have lost all my life savings and have been treated as an imbecile . I am MAD - thank you ALL |

| Not sure I understand---please correct me if I misunderstood---you are here working in this country illegally and want to complain about the unfair working conditions? You stated, " the type of visa we have does not allow us the undertake another employment legally. "Your visa only allows you to work at THIS restaurant and NO OTHER place of employment? Is that a fancy way of saying "illegal immigrant" who paid to come here illegally and knew they were going to be working in an illegal environment---and you want help suing them because you don't have all the advantages of those who came here legally? | Obviously you did not understand-please read before you post I am here legally. I had an interview by the employer in my home country and I was promised enough wages to leave my family behind and come here to find find out I have been lied to and be mistreated in every way possible. We came here with a working visa precisely for this restaurant and the hours provided by them are not even enough to pay my accommodation. Believe me once you find yourself threatened to be on the street because you have no money to pay, you will not consider at all what the immigration law has to say of you taking another employment. Obviously you are not interested at all in helping so don't bother even replying. Seems like you are not happy seeing people to come in this country and work. | You are not an immigrant. The H2B working visa is a nonimmigrant visa which allows foreign nationals to enter into the U.S. temporarily and engage in nonagricultural employment which is seasonal, intermittent, a peak load need, or a one-time occurrence. This visa is, by definition, seasonal, not consistent, reliable, ongoing work to lead to the ability to remain in this country without applying for immigration status. You have wrongfully identified yourself as having immigrant status. You do not, if you indeed are holding only this particular visa. |
