In 2002 I Was Charged With Child Abandoment With Intent To Return In The State Of Texas. My Lawyer Suggested That I Plead No Contest. I Stressed My Concern About Receiving A Felony.he Informed Me That The District Attorney Is Offering Me Probation Deferred Adjudication. He Assured Me Employers Wouldn't Have Access To That Information, So Agreed To The Sentence. In 2006 I Succefully Completed The Probation But The Case In On My Criminol Records And Employers Are Open To View It . I Have Been Turned Away From Jobs Because Of It . What Can I Do? Is It Possible To Petition The Court That Information Given By My Attorney Was Not Accurate. Or Can I File For A Non Disclosure And If So How Long?

Actually, this is not accurate. All felony convictions will remain on the NCIC file for the remainder of your life unless you can get either a pardon or an expungement. Pardons are granted by the Governor of the state and are usually difficult to impossible for the working person to obtain. Expungements are very specific and I will give some basics for this to occur. 1. Expungement is state/crime specific. That means that each state has it's own rules over which felony crime can or cannot be expunged. 2. Time elements apply. Most states demand 5 years free and clear of all legal encumbrances. Some states demand 7 years. 3. Only a first time felony can be expunged. If you have two or more numbers, you are stuck with them for life. 4. The cost of the expungement is solely dependant on the attorney's fees and filing fees for the county you are dealing with. For more information, see where this question was answered in duplicate on another thread. |

Thanks! I don't know Texas laws and this is the state where the incident happen. I now live in minnesota, which makes it difficult for me to find info. I called the Texas law library and they did not give me no info on whether or not i can file for the expungement.I was charged with no conviction(dismissed) of child abandoment with intent to return. when I took the deal from the d.a back in 2002 I was misinformed by my lawyer. My lawyer told me by taking the deal employers would have no access to this information, that is the only reason i didn't fight. I was put on deferred adjudication probation. I completed the term, successfully. i am now in school and now finding a hard time finding a job. what can i do to find out this information i so desprately need. Can I do this without a lawyer and if so, what is my first step.

Go to the solicitors office ( usually they have a web page). And on there you very well may see different links for different services. Many municipalities will have a link that says EXPUNGEMENT. From there, the directions are very straight forward.
Good luck. |
