Default Job Offered by Benefits But can't give benefits

Hi. I was offered a job with salary and benefits, w2, from Nov2007 to present. my employer is not able to give me the other benefits like 401K, dental, medical, disability because they say that there are not enough financial support to meet this.
Can I still demand that they give this since it is what triggered me to work for them anyway?
I would appreciate your replies.
Thank you.

If the offer was in writing, you might be able to get medical for only those months before they told you they couldn't. Benefits are at the company's discretion... they can be terminated at any time unless you are in a union... and clearly you are not. Benefits also usually start after a beginning period where you are still a temporary worker... ie. you must be past the the first review... perhaps that is when they told you there would be no benefits.

i was hired Nov2007 and was on W2 by Feb2008. they have not given me any papers that shows that they cannot give me the benefits anymore. The reason is, they might have allocated the money in a "shady" way that is why they were not able, still, to give the missed benefits.

I asked if you had your benefits in writing. That determines your benefits... not your understanding that they do business in a shady fashion and thus perhaps they didn't go through the right business channels. Either they did give you a brochure saying that after your initial period you would have benefits or they didn't... which is it?
