non-compete and sponsorship
Hello,
I am a practising heart doc in Florida. I had taken the job with my employer since it would qualify for "physician shortage area" and did work there for the past over 3 years. In addition, my employer(ex) had accepted funds from the local hospital to guarantee my salary against my commitment to stay in the area for 4 years. I did leave the job halfway into the fourth year - about 6 months ago.
There was a non-compete clause to the initial agreement that I had signed that restricts me to stay in the area for 2 years.
Question:
1. Does the fact that it is a physician underserved area plus that I had utilised those channels to enter the area - negate the non-compete clause by itself?
2. Additionally, the fact that the hospital also wants me to stay in the area against the accepted money, would the non-compete be enforceable?
