Default PJC in DUI Cases?

My dad received a DUI a couple months ago in Charlotte (NC). He has a clean record, no aggrevating factors, and in short the DUI is probably going to cause him to lose his very high paying job and make it much more difficult for him to pay for college (law school) for me, my brother and my sister. He has already downsized his house.

We know what he did was against the law, he won't do it again, etc. Is it possible for him to get a PJC in such a case or not?

His lawyer seems terribly incompetent. He said his best case is to argue that the officer did not have reasonable suspicion to pull him over. He has not even considered questioning the breathalizer calibration, coughing (etc) before taking the breathalizer, etc. He also said that a PJC is not possible in DUI cases, although I know that several of my friends have gotten PJCs for DUIs in a different district court (granted most of these were "under-21" DUIs).
