Unhappy Pulled Over - But Not Convicted DUI & Background Check

To Whom This May Concern,

About two years ago, I was pulled over for doing 12 over the speed limit. The officer noticed that I had alcohol on my breath and did a field sobriety test which I passed until I blew into the breath alyzer in his car. I blew a .09 - Legal Limit is .08 in North Carolina. He took me downtown to blow again on the official machine and I blew a .07 under the legal limit. He dropped the speeding charge as well as any charge for the DUI.

I just recently passed my Real Estate License Course and needed to get a background check to submit to the Real Estate Commission board. Upon receiving this I noticed that the speeding charge and the dui charge were listed but stated No probably cause. Should this be listed if I was never issued a court date or a speeding ticket. The Background check was intended to pull up misdemenor and fellony charges, and considering I was never charged or convicted of any crime. Should this be on my record for anyone to pull up... or do you believe that this is a clerical error that needs to be corrected... and if so what advice do you have to deal with a situation such as this.
