Default Repeat DWI offender

If a person in Texas was charged with a 7th DWI, what would be the maximum penalty for a repeat offender?

Death by hanging . . . .

. . . or, at the very least, it should be!

I am afraid I have to totally agree on this one - SEVEN ????? Wasnt ONCE enough ? Go to a support group for people who have lost loved ones to drunk drivers - just do it and see how horrible you might feel if something had happened. On my DUI I had been out with a friend who was doing the driving, I got dropped off at home and went to bed - last thing I remember - next thing was waking up in my sleep top and nothing else and in a ditch with my car running. I was nailed - my own fault yes - I should have probably been stopped many times before that - but I am thankful to this day that I never hurt anyone other than myself. I dont understand how this fool got his or her license back after the SECOND one - let alone the SIXTH ! Must be a slow learner or a complete disregard for not only themselves but also for other innocent people. You wanna kill yourself - lock your door and drink your butt to death in your own living room - not on MY streets ! This just really is totally disgusting - SEVEN ?????? I just cant beleive any court would put up with that - the person needs jail time with mandatory counseling

Unfortunately, there was a ring to "my truth". The fact is, people like this live, and wind up killing entire families in an intersection. Only the good die young, or without reason.

While my initial response may have been funny on the surface, the post was exceedingly scary. Believe me, on a written forum such as this, it was the only way I could express a "nervous laugh." It's definitely not a laughing matter.

There are thousands of people like this, each an every minute of the day and night, on our roadways. As defensive as one usually is when driving, there is no defense enough when dodging a drunk driver behind the wheel of a "killing machine" bent on running a red light.

I do appreciate your sentiment. This year has been a difficult one for me after I was struck by just such a driver as you mention
(nevermind he totaled my shiny new convertible on my fortieth birthday!) Although my physical progress has been measured in tiny steps, my emotional healing has been even slower. I suspect I will always have a great deal of anger that the unfairness of it all---a few moments in his day changed my life forever.

I agree totally - I have a now 40 year old daughter - ex step daughter actually but still my daughter in my mind and she got hit by a young kid who crossed the center line and slammed into her Tracker - a light car anyway - and she went through the windshield, in spite of having her seat belt on, it broke and her long hair got caught in the belt, when the jeep flipped over three times and skidded down the road it dragged her with it the whole way til the force of it all finally ripped her hair out and part of her scalp with it. This sounds like it all took a long time to occur but iwas actually a matter of seconds. Once she got thrown to the curb the other car still had momentum going and it then ran her over. By the time she got to the hospital in a coma she had almost every inch of her right side, from her face to her feet literally ripped off her body, broken legs, hips, back, neck, arms and most of her facial bones broken, and a major head injury. This happened September 21st in 2002 and she didnt wake up until the day before Thanksgiving and then was in a nursing home til the following May with a trach tube in her til almost the week before she got released. What once was a workaholic active young woman now can barely walk on her own and she faces many many surgeries still to fix the damage this kid did to her. Her hips still need to be realigned and her right foot is set permanently to the side instead of straight out front like it should be, and her arm is bent perpendicular (sp?) to her body - the main problem was the hospital hkept saying she wouldnt make it through the nite, then when she did, well, she will never wake up, then well, she will never function again so they did the bare minimum to fix her broken bones. She now has had facial surgery to make her face even again - the force of the impact cause her bones to shift to about an inch lower then her left side. Her brain injury is such that her left side works but the right side of her body doesnt - which I have been told is pretty much useless since the opposite sides of the brain make the other sides of the body work. Her right side of the brain doesnt work so well but her left side of her body is functional, but without the right signals going to it that isnt much help. This all happened in Florida but we have her now moved to Illinois back with family to care for her. She lives on her own but has daily halp come in for finances and house keeping. Will never drive again, may never walk without a four pronged cane properly and we are still waiting to see if someone can help with her arm function which would help her balance if they could get it straightened out.

What happened to the kid that hit her ? NOTHING !!!! He walked away with barely a scratch and since he was some silver spooned son of a lawyer my daughter got nothing but payment for her jeep and that was it. No lawyer in Florida would or will touch the case since the kid involved is the son of one of them.

Ruined her life ? Kind of - BUT - she is happy and we are all glad she is alive. The kid should have gone to jail for a long time and would have if his father hadnt of been who he was in the community.
