Default dui arrest/passengers civil rights violated searchrd with no cause

I went to kareoke with my boyfriend and while I was there I had 2 mixed drinks.I then met a friend and had dinner at a redterant.I was pulled over and asked to take a sobriety test and I did.I passed the breath test and the other standard ones they give.The Officer told me we were going to get a blood test and I said no and he then asked me for urine I said sure.I was arrested and put in the car.My boyfriend who was not on probation or parole and did not have a search claus was asked if he could be searched he said no.The officer then took him out of the car and proceded to search him anyway.They found a controlled substance on him and he was arrested also and charged with possession for sales.He does not sell drugs but my confussion is that they never read him his rights and that they searched him with no probable cause.I sold a truck I had for 1500.00 and we went to kareoke between what we spent there and for the burgers I had 1451.00 left over.Drug task force came to the police station and seized my money that was in my wallet and in my purse for a dui.My only charge.I have to file a paper to get it back.I don't think that it was legal the way it all happend.I was not sure if you pass there breath and field test that they could force you to submit to another.My boyfriend is American Indian and his rights were totally violated.Please give me some input on what you know or think we should handle this.Thank you Sheila Eacret

Cool

Please read articles in this section called "Stopped by Cops" and "Not Read Miranda" for specific details about the questions you asked. If you feel your boyfriend's rights have been violated contact an attorney who is familiar with the laws in your state.
