Question home

i am 100% disable and i live in the state of alabama, is there a possiblility of me being made to sell my home if i file for divorce even if i paid for the home while married to my husband and he did not contribute to the paying of the home?he works 40 hours plus week at $14. hr.and i live on a disability income of less than $800. monthly.

A brief review of Alabama law on property of the marriage reveals that it is an equitable division state. As such, the court will divide property of the marriage in a fair manner based on the status and needs of both spouses.

Important factors for the judge will be whether the property was acquired before the marriage, the spouse that made a majority of separate contributions toward the payment of the principal, whether the deed changed to joint tenancy, whether there were agreements between the spouses made before the marriage on the division of property of the marriage, and the ability of each spouse to afford the house, etc, etc.
