The answer depends on many factors one being what state you are in. Your attorney will take a look at all assets and debts, find out when they were acquired or incurred, determine what type of property they are considered, and what intentions there were when property was placed under one or both spouses names.

Make sure the judge makes a ruling and his decision reflects whose name should be on what assets etc.
