I am not blaming this on anyone. I am just trying to find a way to do this . I am sorry . I was just updating on what is going on and the walls I keep coming against. I was hoping for input as to what I can do. I wish it was easy to borrow the money even from my children but it is not. Sorry.

Although I don't advise people doing it themselves, there are do it yourself divorce kits you can buy for a few bucks. Perhaps that would be better than doing nothing. Maybe if you went to the courthouse and ASKED for the paperwork (not legal advice) to start divorce proceedings, and started the process he would get scared and wisen up. Good luck. |

Legal Aid
Since when has legal aid said they wouldn't help someone without funds or income in a divorce? What state are you in? Make the phone call again and talk to someone else. They are obligated to help someone in need of legal aid with no income, just as social services is obligated to make sure the grandchild has food to eat and clothes on his back. Call social services in your county and explain what is going on and get a case file started on the child, and THEY might call Legal Aid for you and get you the help you need. The other issue is the bank, open an account in your name, get on disability because of the medical condition and that's going to take awhile to get going, and start depositing disability checks into your bank account that he can't touch. There is no reason that Legal Aid should not help you and if they refuse I would file a complaint against the agency. The squeeky wheel gets HEARD, so DON'T GIVE UP. And there are attorneys out there even in your state who would agree to do this on a contingency. But I would BANG ON LEGAL AID'S DOOR UNTIL THEY OPEN IT in this case.

Disability denied me. They have not gone as far as to determin disability but because we are married I do not qualify due to his income which I have no access to. I have been denied twice now the latest letter came last week.
Land of Lincoln is the legal aid referral for Adams County they have stated that unless my spouse and i have come to a agreement they can not help me. They sent me papers to take classes and file myself but the papers state clearly if I want support I may not file myslef. I also went to free legal advice at the court house who in turn refered me to Land of Lincoln. Even though I told them that Land of Lincoln said they can not help me. And they told me to call again which I did and was told same thing. I told the person that The legal advice at courthouse told me to call again and was told no matter how many times I call the answer will still be the same. So it is a big Merry Go round. Ive come to the point where I will ust have to accept this as I have no alternatives. The account is bounced. I am getting shut off notices. I have no funds. I am just goign to keep applying for jobs and maybe I will get lucky and find one. Ive applied for low income housing and a waiting on approval to be put on waiting llist. i got the link card so at least I have food for the lil one. Thank you all for your advice.. Jacky |

I think I finally may have a lawyer After the 3rd time going to thelegal advice at courthouse they gave me a referral I called the attorney before even leaving the courthouse. He said I need to come up with filing fees and serving fees. I meet with him Monday. He says can file on adultry and mental cruelty. My spouse has again taken funds but this time took all the money so I dont know how but I will fnd a way. I know this isnt going to be easy and yes I still love him but I know I have to do this for ME. and for the grandchild we have guadianship of.

If this situation wasn't so sad it would be laughable. They can't make you pay his support when you are obviously near indigent and can barely support yourself. Hopefully your new attorney is well aware of what is going on and can help you get through this. Is this man still living at your home with you? Or are you supporting the grandchild now or is he? Thanks for the update

Let’s face it I am getting nothing but more stress and bills.
Divorce I think is for who can pay the most to attorneys I gave the lawyer 400 out of my 600 paycheck The free legal advice at courthouse gave me a referral to him I called him right away. He asked if I could come up with filing fees and serving fees which was the 400. At first appointment he told me his retainer is 1000 and its 150 an hour. But that he would file for my spouse to pay attorney fees. My letters from attorney include the line “Please continue to send payments towards your attorney fees. Concerning my spouse: He has not paid any support in several months As for my attorney I don’t think he cares l was at the court this morning the papers didn’t even go before the judge My attorney walked right past me and when I spoke to him suddenly recalled who I was. The case for me to support my husband and pay his attorney fees has been continued till the 8th of October The case for me to get support has not even been presented When I asked my attorney what am I suppose to do as I am getting evictions bill collections you name it they are repossesing my fridge today, He had no answers I also asked him about grandson and what to do there If my husband shows up wanting him the attorney said there is nothing I can do. I make 600 dollars a month that is barely paying the utilities. And out of that I have to pay the lawyer. So in all essence he has won When he left he moved in with his new woman in Georgia I mentioned to my attorney that I wish I could sue her and he laughed it off. Well I searched the web today and found in the state of Illinois you can file alienation of affection so what was the joke I don’t get it. I think because I can’t pay enough I don’t matter. It sure showed today as I have nothing and they file continuances. Last edited by Jacky : 09-10-2009 at 05:51 PM. |
